Legal
Terms & Conditions
These general terms govern the contractual relationship between Pietra by Bianca and customers who place commissions through the website pietrabybianca.com or by email.
1. Seller identification
[Legal entity name pending]
Registered address: Cádiz, Spain
Email: hola@pietrabybianca.com
2. Subject matter
Pietra by Bianca crafts and sells handmade natural stone furniture and decorative objects, made to order. Each piece is produced specifically for the customer following order confirmation.
3. Order process
The purchase process follows these steps:
- The customer selects a catalogue piece or requests a custom design.
- Pietra by Bianca issues a quote with detailed specifications (material, dimensions, finish, lead time, and price).
- The customer confirms the order in writing (email) and pays the initial deposit.
- Production begins upon receipt of the deposit. Confirmation of commencement will be sent by email.
4. Prices and taxes
All prices are in euros (EUR) and include VAT applicable to purchases made in Spain. For deliveries to other EU countries, VAT may vary according to applicable rules. For deliveries outside the EU, prices may not include customs duties or import taxes, which are the responsibility of the recipient.
5. Payment terms
- Initial deposit: 50 % of the total price, paid at the time of order confirmation.
- Balance: 50 % before shipping, once the piece is complete and approved by the customer via photographs.
- Accepted payment methods: credit/debit card, bank transfer, PayPal.
- For orders under €1,000, full payment may be required at the time of commissioning.
6. Delivery lead time
The standard production lead time is 60 to 90 days from order confirmation and receipt of deposit. This is an estimate and may vary due to factors beyond our control (material availability, piece complexity). We will communicate any significant delay as early as possible.
7. Cancellations
The customer may cancel the order at no charge within 72 hours of confirmation and before production begins. Once manufacturing has started, cancellation will result in forfeiture of the deposit paid, as the material has been acquired and cut specifically for the commission. The cancellation cost will in no case exceed the amount of the deposit.
8. Right of withdrawal
As these are goods manufactured to the customer’s specifications, they are excluded from the 14-day right of withdrawal under Art. 16(c) of Directive 2011/83/EU, as production began with the customer’s express consent.
9. Warranty and claims
All pieces carry a 2-year warranty against manufacturing defects, in accordance with applicable EU consumer goods warranty rules. To exercise the warranty or file a claim, write to hola@pietrabybianca.com with photographs of the defect and your order number.
Natural material variations (veining, tone, texture) are not considered defects and are excluded from the warranty.
10. Limitation of liability
Pietra by Bianca shall not be liable for indirect damages, loss of profits, or consequential losses arising from the use of our products, except in cases of wilful misconduct or gross negligence. Our maximum liability shall be limited to the value of the order in question.
11. Intellectual property
All website content (photographs, texts, designs, logos) is owned by Pietra by Bianca or its licensors and is protected by intellectual property law. Reproduction without express authorisation is prohibited.
12. Governing law and jurisdiction
These terms are governed by Spanish law. Any dispute shall be submitted to the courts of the consumer’s domicile (if a natural person) or to the courts of Cádiz if the customer is a business. For alternative dispute resolution, you may access the EU ODR platform: ec.europa.eu/consumers/odr.
13. Amendments
Pietra by Bianca reserves the right to modify these terms at any time. Changes will not affect orders already confirmed. The current version will always be available on this page.
